T-Livv Club Terms & Conditions

The following terms and conditions (“Terms & Conditions”) apply to your membership in T-Livv ‘The Travel Club’, the loyalty program of T-Livv Inn. Your participation in the T-Livv Club will be governed by these Terms & Conditions. It is your responsibility to read them and to comply with them. By becoming a T-Livv Travel Club member, each member agrees that he/she has read and understood these Terms & Conditions and the T-Livv Inn privacy policy.

1. DEFINITIONS

1.1. Contract: means the contract between T-Livv Inn and the Member of the T-Livv Club in accordance with these Conditions.

1.2. Conditions: means the terms and conditions set out in this document.

1.3. T-Livv ‘The Travel Club’: means the T-Livv ‘The Travel Club’ Loyalty Program, a member recognition programme operated by T-Livv Inn.

1.4. Member: means an individual who is aged 18 years and over who is registered for the T-Livv The Travel Club.

1.5. Membership Number: means a unique T-Livv The Travel Club membership account number issued by T-Livv Inn to Member.

1.6. Member Hotels: means a hotel or property that is part of T-Livv Inn as shown on T-Livv Inn’s website from time to time. Member Hotels can be used interchangeably with T-Livv Inn property.

1.7. T-Livv Inn: means T-Livv Inn registered in Greece with registered office M. Krikeli 5, 84200, Tinos.

1.8. T-Livv Inn Reservation Channels: means the official website and reservation email info@tlivvinn.com.

1.9. Qualifying Stay: means a stay at a T-Livv Inn property whose booking was processed through the T-Livv Inn Reservation Channels.

1.10. Qualifying Points: means each point earned by a Member upon full payment and completion of an eligible reservation at a T-Livv Inn property. Points are automatically credited to the Member’s account when the Member is logged into the WebHotelier Booking Engine at the time of booking.

1.11. Benefits: means the benefits available to Members when they book their stay at a T-Livv Inn property through the T-Livv Inn Reservation Channels.

1.12. Business Day: means a day (other than a Saturday, Sunday or public holiday).

2. TERM

2.1. Your T-Livv The Travel Club membership does not expire.

3. TERMINATION

3.1. You may voluntarily terminate your membership at any time by providing email notice info@tlivvinn.com.

3.2. If your T-Livv The Travel Club membership has no activity for three (3) consecutive years, your account may be deactivated.

3.3. However, any accumulated Qualifying Points and Membership Benefits shall not be reinstated.

3.4. T-Livv Inn may terminate the T-Livv Club program at any time immediately by written notice to Members.

3.5. T-Livv Inn may terminate the T-Livv Club program or any membership immediately where required by applicable law.

3.6. T-Livv Inn may terminate a membership immediately if a Member commits a material breach of the Contract, including misuse of any Benefit or abusive behaviour towards staff.

4. MEMBERSHIP PRICE

4.1. Membership to T-Livv Club is free of charge.

5. QUALIFYING POINTS

5.1. In order for Qualifying Points to be credited to a Member’s account:

5.1.1. Reservation must be made through T-Livv Inn Reservation Channels.

5.1.2. Reservation must be at a T-Livv Inn property.

5.1.3. The Member must be logged into their T-Livv Club account through the WebHotelier Booking Engine at the time of booking.

5.1.4. Stay must be used personally by the Member.

5.1.5. Points are calculated based on the total amount paid for the eligible reservation.

5.2. Members earn fifteen (15) points for every one hundred euros (€100) spent on eligible bookings.

5.3. T-Livv Inn may cancel or adjust any incorrectly credited Qualifying Points.

5.4. No-show stays do not qualify.

5.5. Complimentary stays or reward stays do not qualify for the accumulation of Qualifying Points.

5.6. Points are credited upon full payment and completion of the applicable reservation (checkout).

5.6.1. T-Livv Inn reserves the right to reverse, deduct or cancel any Qualifying Points awarded in connection with a reservation that is cancelled, refunded, disputed, partially refunded or otherwise determined to be ineligible.

5.7. Qualifying Points do not expire.

5.8. Qualifying Points are non-transferable and may not be sold, assigned or exchanged.

5.9. Members may view their points balance and activity through their account on the WebHotelier Booking Engine or by contacting T-Livv Club.

6.2. All benefits are subject to availability and may be modified, suspended or withdrawn by T-Livv Inn at any time without prior notice.

7. COMMUNICATING WITH MEMBERS AND MARKETING

7.1. T-Livv Inn’s use of a Member’s personal details is governed by the T-Livv Inn Privacy Policy which Members should read carefully. By signing up to the T-Livv Inn Loyalty Program.

7.2. Member agrees for their email address to be added to the T-Livv Inn newsletter database and start receiving the T-Livv Inn newsletter.

7.3. Members has the option to opt out from the T-Livv Inn newsletter by clicking ‘unsubscribe’ from any T-Livv Inn newsletter received. By consenting to these Conditions and by supplying a Member’s personal information to T-Livv Inn, Members consent to the terms of the Privacy Policy.

8. LIMITATION OF LIABILITY

8.1. Neither T-Livv Inn, nor any affiliate or subsidiary, makes any warranties or representations, either expressed or implied, and expressly disclaims any and all liability (including consequential damages) with respect to type, quality, or fitness of goods or services provided through the T-Livv Inn ‘The Travel Club’, a Member Hotel, or a third party affiliated with the T-Livv Inn ‘The Travel Club’. Neither T-Livv Inn, nor any affiliate or subsidiary, shall be liable or responsible for any performance or non-performance by any Member Hotel at which Membership Benefits are redeemed, or for any discrepancy in the rooms, facilities, or services available at any such Member Hotel from those set forth on www.tlivvinn.com or elsewhere, and shall not be liable for any damages that may result therefrom.

8.2. This Condition 8 shall survive termination of the Contract.

9. FORCE MAJEURE

9.1. For the purposes of this Contract, Force Majeure Event means an event beyond the reasonable control of T-Livv Inn including but not limited to strikes, lock-outs or other industrial disputes (whether involving the workforce of the Supplier or any other party), failure of a utility service or transport network, act of God, war, riot, endemic or pandemic, civil commotion, malicious damage, compliance with any law or governmental order, rule, regulation or direction, accident, breakdown of plant or machinery, fire, flood, storm or default of suppliers or subcontractors.

9.2. T-Livv Inn shall not be liable to a Member as a result of any delay or failure to perform its obligations under this Contract as a result of a Force Majeure Event.

10. EXCLUSION OF THIRD PARTY RIGHTS

10.1. A person who is not a party to this Contract shall not have any rights under or in connection with it.

11. DEATH

11.1. T-Livv Inn does not permit the transfer of Qualifying Points, Membership Benefits or Tier Status to another Member.

12. INVALIDITY AND SEVERABILITY

12.1. If any provision of these Conditions is or becomes for any reason whatsoever invalid, illegal or unenforceable, it shall be divisible from these Conditions and shall be deemed to be deleted from them and the validity of the remaining provisions shall not be affected in any way.

12.2. If any invalid, unenforceable or illegal provision of the Contract would be valid, enforceable and legal if some part were deleted, the provision shall apply with minimum modification necessary to make it legal, valid and enforceable.

13. ENTIRE AGREEMENT

13.1. These Conditions together with the T-Livv Inn Privacy Policy constitute the entire agreement between a Member and T-Livv Inn regarding membership of the T-Livv Inn Loyalty Program.

13.2. T-Livv Inn reserves the right to amend these Terms & Conditions at any time. The latest version shall be published on www.tlivvinn.com and shall become effective upon publication.

14. LAW AND JURISDICTION

14.1. These Conditions and any dispute, controversy, proceedings or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) shall be governed by, and construed in accordance with Greek law, without giving effect to the principles of conflict of laws thereof that would result in the application of the laws of any other jurisdiction.

14.2. Any legal disputes arising from the present Agreement shall fall under the jurisdiction of the competent Courts of Athens, Greece.
